Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in federal custody.
In her order, the court noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in the state of Tennessee.

The court, who was hearing his petition to removal in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
